针对58个马来非政府组织草拟和提交的国民团结备忘录,民政党署理主席拿督谢顺海医生表示反对。该备忘录的建议包括了在拟定和实行所有政策上,土著须作为官方核心民族或核心群体,同时也建议只允许土著免偿还他们的高等教育基金。

谢顺海医生抨击该不妥当的备忘录,因为其并不是很注重社会中的其他成员,尤其是少数群体的权利或利益。他认为,该备忘录错误推动国内的种族排斥和结构性的歧视,违反了一个马来西亚理念。

 “我们必须坚决抵制任何种族主义、偏见或蓄意边缘化少数群体的观念。平等作为联邦宪法下的其中一个基本自由体现必须受到充分尊重。我呼吁有关群体学习、理解和内在化联邦宪法,不要越界,该备忘录在宪法上不成立和不受社会接受。谢顺海医生说。

谢顺海医生指出,由土权领导的非政府组织联盟不可曲解尊重人权和平等的民主。他强调,多数群体绝不能被视为是压制少数群体较小的利益。他认为,国家的重要决策或政策并不仅仅是多数群体的数字问题,社会各方的同意和接受列入考量是有必要的,以不侵犯他们的权利和利益。他呼吁各方秉持一个马来西亚理念宣扬的中庸和包容,以加强整合与国民团结。

Gerakan Deputy President, Dato’ Dr. Cheah Soon Hai disagreed with a memorandum drafted and passed by a coalition of 58 Malay NGOs in its National Unity Convention yesterday. Among the proposals in the memorandum were including making Bumiputera as the official “Bangsa Teras” or “core group” in the formulating and implementation of all policies and proposing that only allowing Bumiputeras to be exempted from repaying their National Higher Education Fund (PTPTN) loan schemes.

Cheah condemned the ill-considered memorandum as it holds little regards towards the rights or interests of other members of the society especially the minority groups. He held that the memorandum has wrongly promoted racial exclusiveness and structural discrimination in the country which is against the 1Malaysia concept.

“We must firmly resist any idea of racism, bias or deliberate marginalisation towards minority groups. Equality as one of the fundamental liberties enshrined under the Federal Constitution must be duly respected. I urge concerned parties to study, understand and internalise the Federal Constitution and do not cross the line. The memorandum is constitutionally untenable and socially unacceptable,” said Cheah.

Cheah reminded that the Perkasa-led coalition of NGOs must not misinterpret democracy which accords utmost respect for human rights and equality. He asserted that majority must not be seen as suppressing diverse smaller interests of significant minority. He believed that important decisions or policies of the country are not merely a matter of numerical majorities. It is necessary that public agreement and acceptance from all quarters of the society be taken into consideration in order not to infringe on their rights and interests. He urged all parties to embrace moderation and inclusiveness as preached under 1Malaysia to enhance integration and national unity.

Gerakan Deputy President, Dato’ Dr. Cheah Soon Hai praised and supported courageous calls by concerning parties to draw an end to issue of confiscated Bible copies and subsequent controversies that stemmed from its questionable post-issue management. He was of the opinion that all parties must come to a realisation that debates surrounding confiscated Bible copies should be discontinued with national interest and social unity be kept as the foremost priority in the mind and heart of all faithful Malaysians.

Cheah supported Minister in Prime Minister’s Department’s, Tan Sri Joseph Kurup’s call on Attorney-General’s Chambers (AGC) to review into the case involving Perkasa chief Ibrahim Ali’s threat to burn Bibles. He stressed that it is important that the AGC does not prejudge the matter and should have allowed the judiciary to decide. He said Gerakan disagreed with the continuous application of Sedition Act and suggests that Ibrahim Ali could be charged under Section 107 of the Penal code for incitement or abetment to commit criminal offence, whilst seizure and burning of bibles constitutes an offence under Section 441 of the Penal Code for ‘criminal trespass’.

“As previously reiterated by some Gerakan leaders, we call upon AGC to review the case as it is of public interest and to uphold social justice. AGC’s decision not to pursue the case could send a wrong message to the public that burning holy books is a legitimate form of expression, it is a dangerous precedent that we could never afford to mistake,” said Cheah

Cheah also echoed Bishop Dr Paul Tan Chee Ing’s magnanimous gesture for readily extending forgiveness to Perkasa’s president Ibrahim Ali over his bible-burning threat. He continued that while social justice must be pursued, it is even more important for Malaysian public to foster mutual understanding and respect.

“National unity is dependent on our ability to envision social equality and the means to promote it. We must show goodwill and understanding towards our fellow Malaysians, it is the surest way for the nation to move forward,” said Cheah.

针对各方要求中止充公圣经课题及因其争议性的事后处理所引发的延续争论,民政党署理主席拿督谢顺海医生表示赞扬和支持。他认为,所有人必须拥有共识,即充公圣经的争议必须停止,马来西亚人民应以国家利益和社会正义为先。
谢顺海医生支持首相署部长丹斯里佐瑟古律呼吁总检察署,检讨涉及土权主席依布拉欣阿里威胁焚烧圣经一案。他强调,总检察署不应在此事预先判断,应交由司法决定。他指出,民政党不赞同持续使用煽动法令,并建议以刑法第107条文下的煽动和教唆犯罪行为提控依布拉欣阿里,同时夺取圣经和焚烧圣经的行为也在刑法第441条文下构成了非法入侵罪行。
与过往一些民政党领袖所强调的相同,我们呼吁总检察署检讨该案件,因为这有关公众利益和捍卫社会正义。若以总检察署的决定不继续追究此案件,这将向公众传达错误的讯息,即焚烧圣经是一种合法的表达方式,这是一个危险的先例,我们不能承担任何失误。谢顺海医生说。
谢顺海医生也支持天主教马六甲柔佛教区主教保罗陈志英的宽宏行为,宽恕土权依布拉欣阿里的威胁烧圣经言论。他指出,在追求社会正义的同时,马来西亚民众更为重要的是增进彼此的互相理解和尊重。
“国家团结有赖于我们展望社会平等,并促进其的能力。我们必须向我们的马来西亚同胞展现友善和理解,而这也是国家向前迈进的最可靠方法。”谢顺海医生说。
