谢顺海：总检察署应全力协助打击罪案

对于近日激增的枪支犯罪及其他罪案，民政党中央环境、安全与生活素质局主任谢顺海医生表示担忧，并希望警方能更有效和积极打击罪案，同时也应与民间团体，如自愿防卫队、睦邻计划等一起配合，有效地解决罪案问题。

 

谢顺海说，"开斋节期间，我曾与几位警察进行交流，他们指出本身在提控罪犯方面也遇到难题。他们把很多案件提交至总检察署，但总检察署只愿将拥有75%或以上证据的案件控上法庭，其余的他们都不愿把案件控上庭，因为担心无法控告成功。"

 

谢顺海表示，这情况主要是因为政府所实施的KPI造成的。无可否认，KPI是一项很好的指标，可以评估公务员的表现，但总检察署却因若案件控上庭，最后却被判无罪释放，那他们的KPI指标将会受到影响，因此他们只将有把握的案件控上法庭。

 

"KPI指标是好的政策，但政府应作出考量，适当地调整该政策，否则就会出现如总检察署般，为了达致KPI，而放弃提控罪犯。同时，我也希望最近激增的罪案不会作为恢复类似紧急法令的法令，反之政府应加强警力，并积极打击罪案。"

 

谢顺海指出，根据内政部长早前提出的马来西亚警方对人民的比例是1：700，相信是有错误的。现在的制服警员人数是11万2千583人，而马来西亚人口则是2千800万，正确的比例应是1：249，符合国际刑警的标准1:250。因此，有关当局不应再以人手不足作为罪案激增的理由。

 

最后，谢顺海希望网上报案系统能尽早实行，以方便人民报案。同时，他也认为破案率应作为警方升职的标准，以提升警员士气，有效地打击罪案。

Regarding the recent spate of gun violence and other crimes, Gerakan Central Bureau on Environment, Safety and Quality of Life Chairman, Dr Cheah Soon Hai has voiced his concern and hopes that the police can be more aggressive and effective in combating crime and at the same time cooperate with civil society organizations like RELA and Rukun Tetangga to effectively solve the crime problem.

Dr Cheah said "During the Hari Raya period, I met with some police personnel and they pointed out that the process of charging a criminal was also difficult. After investigations are completed the case is then referred to the Attorney General's Chambers but the AGC will only proceed with cases that have concrete evidences of 75% and above due to the fear of the suspect being found not guilty. This is causing the people to distrust the police as many cases does not lead to the suspect being prosecuted."

He said that this situation happened due to the introduction of the KPI by the government although there is no deny that the KPI is well intended system to gauge the performance of civil servants. However, if the AGC decided to prosecute a case but were unsuccessful as the defendant was found to be not guilty, their KPI of the AGC will be adversely affected. Hence, they only proceed with cases that they believe to have a high chance of winning. Dr Cheah called on the government to re-look at the KPI system for the AGC and ensure that it does not hinder the fight against crime.  At the same time, he also hoped that the recent spate of crime rate will not be used as an excuse to revive the EO law. Instead the government should increase more manpower to fight crime.

Preventive laws do not solve the problems, only smart and effective policing and strict adherence to the rule of law will ensure that crimes decrease. Criminals do not fear the justice system let alone respect it because it is ineffective. Stopgap measures like the EO actually lowers the efficiency of the criminal justice system as the police do not need to investigate a crime and the AGC need not charge the suspects as they can be detained extrajudicially and I find this regressive."

Dr Cheah pointed out that according to the Home Minister calculation on ratio of police to population is 1:700 which is believed to be inaccurate. Currently, police personal numbered at 112,583 while the Malaysian population is 28 million. That means the ratio should be at 1: 249 which complies to the international standard of 1: 250. Therefore, the authorities cannot say that the lack of manpower is the reason for the increase in crime rate.

He also hoped that the online reporting system can be implemented as soon as possible to make it convenient for people to report crime to the police. He believed that by using the crime solving rate as the base for promotion, it can boost the morale of the personal to fight crime more effectively.

针对一名身居高职的警员在沙巴亚庇被控性侵13岁少女，吉打州民政党主席谢顺海医生表示遗憾，并严厉谴责该名警员的行为。

 
 

同时也是民政党中央环境、安全与生活素质局主任的谢顺海指出，警员涉嫌不当行为案件早已听闻不少，因此，政府在商定以其他法令取代紧急法令时，必须考量多个方面，以避免出现警方滥权问题。

 
 

"这些预防性法令大多容易出现滥权问题，无可否认很多警员都是正直及品行良好，但只要有0.5%的警员品行不当，这将会造成很多人受伤及人民对警方越来越失去信心。因此，我希望新的法令可以真正防范罪案，并力求所有调查透明化及公正，确保警方不滥用权力。"

 
 

谢顺海表示，警方人手确实需要增加，但为了确保警方不滥权，成立独立警察投诉与行为不检委员会是势在必行的。虽然政府一再表示执法机构廉正委员会可以取代，但至今我们依然不了解其操作及该委员会的主席、成员究竟是谁。因此，为了能恢复人民对警方的信心，独立警察投诉与行为不检委员会是势在必行的应马上成立。

Referring to the case where a high ranking police officer suspect was detained for raping an underage 13 year old girl in Kota Kinabalu, Sabah has brought, Kedah Gerakan State Chairman Dr Cheah Soon Hai to express his regret and condemned the act.

 
 

Dr Cheah who is also Gerakan's Central Bureau on Environment, Safety and Quality of Life Chairman pointed out previous cases where police personals are involved in criminal acts are not uncommon to the people. Therefore, with the government discussing to establish a new replacement EO law, other vital factors must be discussed to prevent abuse of power from happening.

 
 

"These preventative laws will cause plenty of power abuse cases. While it is undeniable that there are many good police personals, even a small amount numbering 0.5% of bad apples will cause a lot of damage, lowering the public confidence towards the force. Therefore, I hope that a new law can be established to fight crime effectively while at the same time all investigations to be done in a transparent and fair manner to prevent the police from abusing the law."

 
 

Dr Cheah added that while the number of police personals required additions, it must also be guaranteed that they will not seek to abuse their power. Establishing the IPCMC is a must although the government said that the EAIC can replace the IPCMC's role. This is because up until this day, we do not know how the EAIC operates, who are its chairman and members. In order to recover the public confidence, the IPCMC must be set up.

Regarding the proposal made by PM Najib about tabling a new law in September to replace the EO, Kedah Gerakan State Chairman, Dr Cheah Soon Hai welcomed the idea. At the same time, he said that the new law must guarantee to be free from abuse and violating human rights.

 
 

Dr Cheah who is also Gerakan Central Bureau on Environment, Safety and Quality of Life Chairman pointed out that the new law would increase the crime solving rate, however police personals must first receive rigorous training and knowledge to make it an effective law to solve crime. Besides, the new law must not be like the EO, which is notorious for allowing the public to see it as a weapon for the police to abuse. Instead, it must be used to fight crime and deter would be criminals.

 
 

"With the implementation of this law, the EAIC must also do their work properly to ensure that investigations are done in a fair and transparent manner to return public confidence in the police. Furthermore utilizing crime solving rate should also be used as a promotion factor since many police are not serious in fighting crime. With the implementation of this new requirement, hopefully there will be an improvement."

 
 

Dr Cheah stressed that we must not solely depend on this law to prevent crime from happening as the police must take a ction to ensure public safety. At the same time, the new law must not only used on high profile cases because what the public are concern the most are petty crimes with substantial impact on their safety and lives such as snatch thieves, robbery and metal stealing. Although these are small cases, it will possessed a serious threat to the public, hence the need for the cops to combat these crimes. Furthermore, the government should consider implementing a law to fight Mat Rempits as their activities affect public lives.

 
 

He said "The government must establish a Sentencing Council to ensure consistent sentencing. For example in rape cases, some are sentenced 1 year but some are sentenced for 10 years. What are the requirements for such sentencing? This has to be made clear or else the people will remain unsatisfied."

 
 

Dr Cheah also pointed out although the new law is good, it still requires the police to take crime fighting seriously. Therefore, they must work hard to recover public confidence towards them.

针对首相纳吉宣布将于9月的国会提呈新法令取代紧急法令，吉打州民政党主席谢顺海医生表示欢迎。同时，他也表示新的法令必须确保不会发生滥权及侵犯人权的情况。

 
 

同时也是民政党中央环境、安全与生活素质局主任的谢顺海指出，该法令主要是为了提升警方的破案率，警方必须接受严格的训练及提升装备，以能有效破案。新的法令不应再像以往的紧急法令，让人民误以为是警方滥权的工具，反之应积极打击罪案，阻吓那些欲犯罪的人。

 
 

"在实施新的法令下，执法机构廉正委员会也必须同时执行其职责，确保所有调查必须公平及透明化，以让人民对警方恢复信心。同时，破案率也应作为警察升职的条件，很多警察根本不认真打击罪案，若实行破案率为升职条件，相信能大大提高破案率吧。"谢顺海说

 
 

谢顺海强调，我们不能只依靠预防性法令来预防罪案，警方必须付诸行动，加强一切安全措施，维护社会及人民安全。同时，新的法令不应只注重高调的犯罪活动，其实人民真正担心害怕的是那些微型但却严重影响他们生活及安全的罪案，如抢劫、攫夺、偷铁盖等等。虽然这些都是很小的罪案，但确实严重影响人民，因此，警方也应全力打击诸如此类的罪案此外，政府也应考虑实施新的法令对付飙车党，因为这影响周围居民的生活。。

 
 

谢顺海说，"政府也应设立量刑委员会，统一所有罪案的刑罚。就以强奸案为例，有些犯案者判监1年，有些则10年，究竟判决的标准是什么？这些都应厘清，否则人民不会信服。"

 
 

谢顺海指出，新法令固然是好，但归根究底还是需要警方的通力合作，严厉打击罪犯。因此，警方须重振，让人民对其信誉恢复信心
