民政党吁警方严厉打击罪案

针对最近2起的枪击事件,民政党中央环境、安全与生活素质局主任谢顺海医生对受害者家属致以深切的慰问,并表示担忧我国的治安与安全。

 
 

谢顺海医生说,"最近我国罪案越来越严重,甚至发生多起枪击案。日前我在曼谷与寮国遇到在我国深造的学生,他们也一致认同我国治安不靖,并表示在吉隆坡逛街时须很小心保管财物,以避免让抢匪有机可乘。"

 
 

谢顺海医生指出,我国治安差劲不但会让外国游客却步,也严重影响人民的安全。就以最近这2宗枪杀案为例,已造成12伤。有鉴于此,警方应严厉打击罪案,维护社会安全,恢复人民对我国治安的信心。

 
 

谢顺海表示,执法机构廉正委员会也是时候扮演其角色,调查涉嫌枪击事件的警员,以让人民能真正了解该委员会的职责。同时,若真要以执法机构廉正委员会取代独立警察投诉与行为不检委员会,调查就必须是公平和透明化,而不是仅限于内部调查,那才能确保人民对该委员会的信心。

 
 

"执法机构廉正委员会可以委任警员调查此事,而委员会则扮演监督的角色,这不但能有效破案,也能达致双赢局面。"谢顺海说。

 
 

谢顺海强调,警方必须严正看待我国治安问题,犯罪者日益猖狂,已严重影响我国人民安全。警方须立即采取行动,加强安全措施,有效打击罪案。我国可效仿香港的打击罪案制度,该国在6070年代的罪案也很猖狂,但现在香港的治安安全却是世界数一数二的。

Regarding the recent 2 shooting cases, Gerakan Central Bureau on Environment, Safety and Quality of Life Chairman, Dr Cheah Soon Hai has voiced his sympathy to the victims families and expressed his concern regarding the safety in the country.

 
 

 "Recently the crime rate is getting more serious, demonstrated by shooting incidents. Previously, I was in Bangkok and Laos and bumped into students who are studying in Malaysia. They all agreed that the safety in Malaysia is dismal. When moving around KL, they have to be constantly careful with their belongings to avoid being robbed," said Dr. Cheah.

 
 

Dr Cheah pointed out that the terrible crime rate in our country will not only deter tourist, but also affect locals. By taking example of the 2 shooting cases which has caused 1 dead and 2 injuries, the police must step up their efforts to combat crime to protect the safety and restore public confidence in local security..

 
 

He added that now is the time for the EAIC to play their role in investigating the alleged police involvement in shooting incident, so that the people can have a better understanding the role that EAIC is playing. At the same time, if the EAIC intends to replace the proposed IPCMC, the investigation conducted must be fair and transparent instead of being done internally to increase the public confidence in the EAIC.

 
 

"The EAIC can appoint police personals to conduct the investigations; however the supervisory role must remain with them to have effective case solving and achieving a win-win situation."

 
 

Dr Cheah further stressed that the police must seriously look into our crime rate for criminals are getting more violent which severely affects our citizens. The police must take immediate action by increasing safety methods to fight crime effectively. He said we can learn from Hong Kong for during the 60's and 70's, it was notorious for its crime. However, Hong Kong currently occupies a high spot in terms of safety in the world.

烟霾再次重现各大市区

近日烟霾再次袭击马来西亚各大市区,民政党中央环境、安全与生活素质局主任谢顺海医生指出,马来西亚应与新加坡采取坚定的立场,向印尼表达强烈的不满,并有效地解决烟霾问题。

 
 

谢顺海说,"预防胜于治疗,我们不应每次等到烟霾问题发生时,才来设法解决,而是应该一早就采取预防的步骤。马来西亚应在东盟会议时,就向印尼高官指出烟霾问题,让他们能采取预防行动,避免烟霾问题困扰马新两国。"

 
 

谢顺海表示,烟霾问题一年发生2-3次,这已严重造成人民的困扰,影响他们的日常生活。我们不能等到烟霾问题发生才来想办法去解决,这根本不是一个有效率的方式。马新两国应与印尼方面达成协议,不要每次讨论了该项课题就无疾而终,烟霾始终困扰马新两国。

 
 

"印尼应成立一个相关委员会,认真探讨烟霾课题,并有效地解决该问题。马新两国也可透过其他方式协助印尼烧芭问题,以达致双赢局面。同时,政府也应禁止人民露天焚烧,以免使烟霾问题更恶化。"谢顺海强调。

 
 

谢顺海表示,政府必须公开涉及印尼烧芭的名单,即使其可能是马来西亚的财团,我们不可因一小群人的利益,而牺牲人民的健康。

 
 

谢顺海指出,烟霾问题已困扰我国多年,我们应采取更坚决的立场,以能有效地解决烟霾问题。

Recently, the returning haze to big cities has prompted Gerakan Central Bureau on Environment, Security and Quality of Life Chairman, Dr Cheah Soon Hai to point out that Malaysia and Singapore should take a firm stand towards Indonesia by voicing their dissatisfaction in order to solve the problem effectively.

 
 

Cheah said "Prevention is better than cure. We must not wait for the haze to happen and then try to solve it. Instead, we should try to prevent it from happening. During the ASEAN meeting, Malaysia must voice out the haze problem to the Indonesian Foreign Minister so they can prevent the haze from affecting our country and Singapore as well."

 
 

Cheah added that the haze hits the country about 2-3 times a year, causing the people to suffer and affecting their lives. We must not wait for the haze to happen then only we try to solve it as this is not an effective method. Malaysia and Singapore must have an agreement with Indonesia because in previous meetings, after a pledge was made, it was merely forgotten until the next haze outbreak which still affects Malaysia and Singapore.

 
 

"As for Indonesia, a committee should be established to seriously study the haze problem for an effective solution. Meanwhile, Malaysiaand Singapore should look into other avenues to provide assistance in other to achieve a win-win situation. At the same time, our government must ban open burning to prevent the haze from becoming more serious."

 
 

Cheah pointed out that the government must also publicly reveal and shamed the culprits behind the burning although it might be a Malaysian consortium for we cannot sacrifice the well-being of an entire nation just for the greed of a small group of people.

 
 

Finally, he said that the haze problem has been affecting us for many years and it is about time to take a firm stance to solve the problem effectively. 

Gerakan: Re-register voters before GE14

 
 

Gerakan wants the Election Commission (EC) to work closely with National Registration Deparment (JPN) to re-register voters according to their residential address. 

Gerakan acting president Chang Ko Youn said this could prevent traffic congestion as voters travelled back to their hometowns just to cast their votes during elections.

"Why vote in Teluk Intan or Bagan Datoh when your addresses are in Kuala Lumpur," he told reporters after a Gerakan central committee meeting in Kuala Lumpur today. 

The scenario was unhealthy and created a very unfair situation to people in many constituencies as these "outsiders" did not understand the local political issues and voted based on feelings influenced from what they read in the Internet, he said.

"All these people may come back once in five years, not knowing what is going on for the past five years, they just cast their votes and after voting, they go back to their homes in Petaling Jaya or Penang, leaving the local residents in limbo, why because when they cast their votes, they do not know the local scenarios and let the local residents face all the problems all over again," he said.

He said by doing the re-registration exercise, the issue of phantom voters would surely diminish.

Chang also raised the issue of the indelible ink which he said was a very primitive method used only in Third World countries in Africa as their governments did not have a good system to register their citizens as voters.

"But for Malaysia, we have a good system under the JPN, we have all the data of the people, why not use the biometric system, just your thumbprint, that's the best way," he said.

The usage of indelible ink raised many unfounded issues and complaints especially from the opposition, the use of biometric system would solve many issues and after all, Malaysians had identity cards, he said.

MCA-Gerakan-SUPP merger?

Meanwhile, Chang was also asked if there was a possibility for Gerakan to merge with MCA and SUPP to form one single party before the 14th election.

He said it was an old idea raised by MCA about 30 years ago.

He said the current political situation today might pave the way but issues such as the constitutions of the parties needed to be resolve.

"Gerakan is a multi-racial party and is open to Indian, Malay, Siamese but some components of Barisan Nasional such as MCA need to change their party constitution as MCA is only for the Chinese people," he said.

Chang admitted that unofficially there were talks about a merger among members but this had yet to be discussed among party leaders.

针对全国总警长卡立阿布巴卡希望内阁重新审议和修订防范性法令取代紧急法令,让警方拥有更大权力能更有效地对付罪犯,民政党中央环境、安全与生活素质局主任谢顺海医生表示不赞同该项建议,并认为刑事法典下现有的法律已足以应对近期飙升的犯罪率。

 
 

谢顺海认为,多数罪案都属于轻罪或轻微犯罪,如街头罪案和抢夺案都没有直接对公共秩序构成威胁。因此,没有必要重制类似已被废除的紧急法令的预防性法律。相反,他敦促警方重振表现,并通过破案率来作为晋升的标准。

 
 

谢顺海表示,内政部长拿督斯里阿末扎希指出因独立警察投诉与行为不检委员会与执法机构廉政委员会权力重叠,因此拒绝设立独立警察投诉与行为不检委员会。虽然现在拥有执法机构廉政委员会,但民众却完全不了解其运作详情,因此政府有必要宣布执法机构廉政委员会的详情,并解释如何运作该机构及谁是机构成员,否则人民是不会信服的。

Regarding the recent statement made by the IGP, Tan Sri Abu Khalid Bakar saying that the Cabinet should review and amend a suitable preventative law to replace the abolished Emergency Ordinance (EO) in order to provide more power to the police to conduct their investigation, Gerakan Central Bureau on Environment, Safety and Quality of Life Chairman, Dr Cheah Soon Hai voiced his disagreement over the suggestion as he maintained that existing laws under the Penal Code are adequate in addressing the recent spike in crime rate.

 
 

He opined that most of the crimes committed are misdemeanors or petty crimes such as street crimes and snatch thefts that do not post an immediate threat to the public order. Therefore, there is no need for the re-enactment of preventive laws similar to the repealed EO. Instead, he urged the police to buck up on their performance and use the clearance rate in crime-solving as the yardstick for promotion.

 
 

Dr Cheah said that the Home Minister, Ahmad Zahid Hamidi said that the IPCMC is playing the same role as the current EAIC and rejected the set up of the IPCMC. But the general public appeared unfamiliar with the operation procedures of the EAIC. So it is necessary for the government to inform the public about the procedures EAIC operates together with the name of its members to gain the public trust.

 
 

He pointed out that if the Home Ministry wants to stick with the existing EAIC instead of the newly proposed IPCMC, first it has to make the people understand that the functions of both organizations are the same with the only difference is that the EAIC will be in charge of scrutinizing all law enforcers in the country including the police.

 
 

"I hope that the EAIC will not only conduct internal investigations but to conduct it in open air in the view of the public to ensure transparency. Also it has to conduct its investigation independently and provide an avenue for the public to remain updated. If not, the public will not let the existing EAIC to take precedence over the mooted IPCMC

对于阿末扎希指因紧急法令被废除后,抢匪和罪犯都被释放出来,导致街头罪案日益增加一事,民政党民政党中央环境、安全与生活素质局主任谢顺海医生大表反对,并认为罪案增加的是因为警方并没有作出详细的调查,继而导致罪犯容易脱罪。

 
 

谢顺海医生指出,阿扎末希指罪案增加是因为紧急法令被废除根本就是无稽之谈。在香港、美国等国家根本没有类似的法令,但这些国家却能很好地打击罪案。

 
 

"罪案增加主要是因为警方没有详细地调查所有罪案,即使某些罪犯被控上庭,但他们还是能因证据不足而脱罪,致使他们一再地犯案。"谢顺海医生说。

 
 

谢顺海医生表示,紧急法令只是鼓励警方不进行调查,并以自身判断力捉拿某个嫌疑犯,但这其实是不正确的。在法律,每个人都是清白,若警方依靠感觉捉拿某个人,这就已触犯了法律的根源。

 
 

"罪案增加的另一因素是警方不正视小罪案,如偷窃、非礼等等。他们不详细去调查,但把罪犯控上法庭时,又因证据不足让这些小罪犯脱罪,这都会导致这些小罪犯越来越猖狂,最后犯下大案。"

 
 

谢顺海医生指出,紧急法令也会造成滥权的现象,若真有紧急法令,独立警察投诉与行为不检委员会也应该成立,这才能让民众信服。此外,我国也有必要设立量刑委员会,以对所有案件作出公平与相同的判罚。

 
 

最后,谢顺海医生对于阿末扎希指华裔对罪案袖手旁观大表反对。他指出,华裔积极参与社区的志愿巡逻队、义务消防队等等,牺牲了自身的时间,就为了确保居民的安全,这完全可证明华人重视罪案,并积极打击罪案,并不如同阿末扎希所说的华裔不关心罪案。

Regarding the statement made by the Home Minister, Ahmad Zahid Hamidi saying that the repelment of the Emergency Ordinance (EO) has caused criminals to be let go easily and increasing the crime rate, Gerakan Central Bureau on Environment, Security and Quality of Life Chairman, Dr Cheah Soon Hai voiced his disagreement, saying that it is because of the police having a take it easy attitude that causes these criminals to be let go scot-free.

 
 

He pointed out that Ahmad Zahid's statement regarding the increase of crime rate was due to the abolishment of the EO as nonsense, also demonstrating that Malaysia is moving backwards. He said that there was no such kind of law in the United States or Hong Kong but they are still able to combat crimes effectively.

 
 

"The reason of the increasing crime rate was because the police did not undertake a serious investigation, causing the accused to be freed easily and repeating their crimes."

 
 

He added that the EO will only encourage the police to rest on their laurels while investigating, but rely on their instincts to take action which is not right. In face of the law, everyone is innocent until proven guilty and if the police rely on their instinct to arrest an individual, this is against the fundamental principles of the law."

 
 

"Another reason why the crime sky-rocketed dramatically was due to the police not prioritizing petty crimes such as stealing or harassment. When these criminals are charged in court but being freed due to the inadequate amount of evidence, this will encourage them to become bolder to commit a serious crime."

 
 

Dr Cheah pointed out another weakness of the EO that it will also encourage abuse of power and if there is an identical law to replace the EO, the IPCMC must also be set up to convince the public regarding its transparency. Besides, a sentencing committee must also be established to provide a fair judgment to all cases.

 
 

Finally, he disagreed with another Ahmad Zahid's statement saying that the Chinese are not concerned about the crime rate. Dr Cheah said that the Chinese community is very active in organizations such as RELA to combat crime, sacrificing their personal time in order to safeguard their neighbourhood. This proved that the Chinese are unlike what has been described by the current Home Minister.

Regarding the Online Police Reporting System (OPRS) that will be introduced in September 2013, Gerakan Central Bureau on Environment, Safety and Quality of Life Chairman, Dr Cheah Soon Hai welcomed the decision made by the government. He also said that previously he has suggested the need for an OPRS.

 
 

Dr Cheah pointed out that the OPRS brings benefit to the people as the public is not required to make a report in a police station. Through this system, the public can make online reports through websites launched by the police by using smartphones or through computers. At the same time, he hoped that the police will have regular maintenance of the system and make sure that it is accessible to even the rural areas.

 
 

"Other than the OPRS, I would like to highlight another issue which is the need for the government to review and establish the IPCMC in an effort to recover the image and public perception of the police. By setting up the OPRS and IPCMC simultaneously, this will increase the efficiency in combating crime."

 
 

Regarding on another matter, Dr Cheah said that Malaysia also required a Sentencing Council to ensure that all court cases are being fairly dealt with. He exampled the Chee Gaik Yap case where other rapists were founded guilty for committing a crime, but in his situation, the accused was acquitted despite having tons of evidence stacked against him. He repeated that this is the reason why our country needs a Sentencing Council to ensure fairness in the handling of court cases.

 
 

Finally, he urged the people to use the Online Police Reporting System for their benefit instead of making false reports to demonstrate the true co-operation between the police and the public.

Gerakan Central Bureau on Environment, Safety and Quality of Life Chairman Dr. Cheah Soon Hai expressed his regret over the tragedy where the lightning rod of the UMNO building in Penang collapsed and caused casualties. He offered condolences to the victims' families.

 
 

Dr. Cheah pointed out that the government should set strict building review guidelines and closely monitoring the safety of all buildings. In the past, most of the buildings did not have any regulations set to prevent destruction from gale or typhoon, while at the present, we can find out that many buildings now have erected a lightning rod, radio masts and towers as well as other massive structures atop of their buildings. Therefore, we must take into consideration on the strength of these structures, whether they can withstand the strong blast of a gale or typhoon in order to avoid the recurrence of the similar tragedy.

 
 

"I hope the authorities will be able to identify the real cause of this collapse instead of shirking their responsibilities to each other. If it is concluded that the tragedy was the result of negligence by the contractor or other related party, then stern action must be taken in order to prevent it from happening again," said Dr. Cheah.

 
 

He also said that after this incident, future building review guidelines must take into consideration the elements of gale and typhoon to avoid any casualties.
